Notice: Animal Control Ordinance Changes and Updates

 Ordinance # 015-8
That Chapter 2, Article 2.1, Section 2.103 ,Section 2.105, Section 2.117 and Article 2.2, Section 2.201, Section 2.203, Section2.204, Section 2.205, Section 2.206 of the Code of Ordinances, City of Kountze, Texas, is hereby amended to read as follows:

Be it ordained by City Council of the City of Kountze, Texas

Section 2.103  General Regulations - Minimum Distance Animals and Fowl to be Kept From a Dwelling
It shall be unlawful for any person to keep, possess, or maintain in the corporate limits of the City of Kountze, Texas, any cows, bulls, steers, calves, horses, mules, sheep, goats, poultry, or rabbits within 200 feet of any actual residence or habitation for human beings, or within 500 feet distance of any commercial, governmental, or institutional building, other than the residence of the keeper, possessor or owner of such animals or fowl.

Section 2.105  Exceptions
4. To the keepers of any livestock who have attained written permission from all actual residences or habitations for human beings, or commercial, governmental, and institutional buildings that are within the minimum distance that animals and fowl be kept from a dwelling, etc. (see sec 2.103)
Section 2.117  Food and shelter
All animals residing outside shall have adequate housing in proportion to its size.  Said structures shall consist of three (3) sides, sloped roofing, and attached flooring.
Dogs residing outside shall have a living area of not less one hundred (100) square feet per animal.
Chaining of dogs in the city limits of Kountze are forbidden.  Acceptable forms of confinement are fenced areas and pens with dimensions of not less than one hundred (100) square feet per animal(see section B).  Overhead runners are also an accepted form of confinement and must be at least twenty-five (25) feet long, constructed no more than eight (8) feet above the ground, and have a ten (10) foot dropline.
All livestock residing inside the city limits of Kountze shall have a six hundred (600) square feet of living area per animal.
All fowl and rabbits must be confined in a pen, coop, or hutch with adequate protection from the elements.  A fenced in yard is not deemed an acceptable form of confinement.
The City of Kountze reserves the right to deem what is an acceptable form of confinement in all instances.
The City of Kountze reserves the right to deem what is adequate protection from the elements in all instances.

Article 2.2Animal Licensing

Section 2.201Required

It shall be unlawful for any person within the corporate limits of the City of Kountze, Texas, to own, keep, posses, harbor, or allow to remain on premises under his / her control, any animal, male or female, without having paid a licensetherefore as hereinafter provided.

Section 2.203 Animal Licensing - Vaccination Required Prior to Licensing

No license shall be issued for any animal owned, kept, possessed, harbored, or allowed on the premises of any person and under his control unless said animal shall have first been vaccinated against rabies by a veterinarian duly licensed to practice in the State of Texas; within twelve (12) months prior to the issuance of such license. There shall be delivered to the City of Kountze, Texas, prior to the issuance of such license, a certificate signed by a veterinarian, duly licensed to practice within the State of Texas, that said animal has been duly vaccinated, giving the date of the vaccination therefore, and thereafter on payment of the fee as provided herein, the city shall then issue, license for said animal.
Other vaccinations may be deemed necessary dependant on type of animal applying for license within the corporate limits of the City of Kountze.
The City of Kountze reserves the right to deem which vaccinations will be required prior to licensing for all animals.

Section 2.204 License Records; Tags

On payment of such license fee as provided herein, the city shall keep a register of all licenses issued in which shall be entered the name of the applicant, description of the animal, numbers of the license and tag issued, and the date of issuance and expiration.Such metal tag shall be attached to a collar or harness of the animal for which issued, and worn by the animal at all times when on the streets, alleys, sidewalks, or public grounds of the construed as in any way excusing a licensed animal form the restrictions imposed by Section 2.308 hereof.In the event a tag is lost, a duplication will be issued on application and payment of a fee as provided for in the fee schedule found in the appendix of this code.

Section 2.205  Current Owners to Comply
It shall be the duty of each person owning, keeping, or having in possession any and all animals within the corporate limits of the City of Kountze, Texas, within thirty (30) days from the effective date hereof, unless a license fee for said animal has heretofore been paid for the current year, to pay the City of Kountze, Texas, a license fee, as provided for in the fee schedule found in the appendix of this code, which shall be effective through December 31, 2015.On or before the expiration date of said license of each succeeding year hereafter, every person owning, keeping, or having in possession any animal shall pay an annual license fee, as provided for in the fee schedule found in the appendix of this code, on each animal which license fee shall be effective for the ensuing year.

Section 2.206  Exceptions
The aforesaid provisions of this article requiring a licensing of all animals shall not apply to the following:
Animals under the age of six (6) months if kept within a sufficient enclosure.
Animals owned by or in custody or under the control of persons who are not residents of the City of Kountze, Texas, traveling through said town or temporarily sojourning therein for a period not exceeding twenty (20) days.
Animals brought to said town exclusively for the purpose of entering same any animal show or exhibition, and which are actually entered in and kept at said show for exhibition.


Notice: Billing Cycle Changes and Disconnect Policy
City of Kountze
1. All utility meters for the City of Kountze will be read the first Tuesday of the month.

2. The utility bills will be mailed out the following week on  Wednesday (8 days following meter reading).

3. All utility bill balances are due the 4th Tuesday of the month (21 days following meter reading). Customers can pay with cash, check, or money order until 5:00 PM to prevent 10% penalties from being assessed. 

4. The following Wednesday (22 days following meter reading), a 10% penalty will be assessed to all delinquent accounts.  Any account with arrears greater than $10.00 will be added to the termination list.  A serviceman will be dispatched the following morning to proceed with the termination of utilities.
Serviceman and office rules:
a.The serviceman may not accept any payment but, will leave a disconnection notice on door and lock all meters.

b. The serviceman may not discuss account or arrangements with customer.

c. No checks will be accepted after 5:00 p.m. on due date, (16 days following meter reading cycle).

d. All accounts will be assessed a $50.00 reinstatement fee after 5:00 p.m. on due date.

e. No arrangements will be made on cut off day.
f. If account is not reconnected within three (3) business days, the deposit will be applied to the outstanding balance and a new deposit will be required to reconnect services.
5. Arrangements - All arrangements need to be made before 5:00 PM on the
22nd day after meter reading (day before cut off day).
      Conditions of Arrangement:
a. Must pay current bill each month plus an agreed amount of at least 25% of the arrears portion.

b. No changes in arrangements are permitted.

c. May have their utilities disconnected without any further notice if arrangements are not kept.

d. All arrangements shall be paid in full on the Monday prior to the start of the next utility bill cycle (the Monday before the first Tuesday of the month).

e. No more than 2 arrangements can be made in a 3-month period.

f. Once a payment arrangement has been broken, no further arrangements will be allowed for one year.
6.After the customer has made the disconnect list on the 3rd time and each time after, the
customer will have to pay an additional deposit of $25.00. If the customer does not have
a deposit for utilities with the city, then the customer will have to pay the regular deposit
of $100.00 for water and $100.00 for gas. The customer will also be required to pay the   
full amount of the account, plus the $50.00 reinstatement fee before services will be
